Wal-Mart foes seek city records
TEGA CAY -- The group opposing a Wal-Mart supercenter in Tega Cay says it believes the city hasn't given it all the information it has asked for under state public records laws.

City Manager Grant Duffield says he has handed over the pertinent records.

Five members of the anti-Wal-Mart Us Against the Wal group gave Duffield on Monday another list of requested documents, including all documents and correspondence between the city and Wal-Mart and all Stonecrest development records about the plan.

The controversial Wal-Mart is proposed to go inside Stonecrest development, a 122-acre commercial and residential development close to the intersection of Gold Hill Road and Hwy. 160. Wal-Mart would be near the intersection of Dam Road and Hwy. 160. One of the group's leaders said she thinks there's more information out there than the city has given the group.

"I don't know what's available out there," spokeswoman Hope MacBride said.

The group wants to make sure the council won't approve the retailer without investigation, McBride said, and that's why it has sought the documents.

The group Aug. 2 requested all documents regarding the city's negotiations with Wal-Mart relating to the development of a Wal-Mart Supercenter, including all correspondence, notes, e-mails and electronic files.

City Attorney Bob McCleave responded to the letter, saying there have been no city negotiations with Wal-Mart. The city has asked about Wal-Mart's ability to make philanthropic contributions to the community, but there are no notes on the conversations, the letter states.

MacBride and Teri Ackerman, another opposition group leader, said there could be memos between the city, Stonecrest developer Bryan Tuttle and Wal-Mart representatives. But those memos could be tough to get under the state sunshine law, said Kirby Shealy, lawyer for the S.C. Press Association. Any information about proposed contracts between the city and Wal-Mart is exempt from disclosure until the deal is done.

The opposition group said the traffic study recently completed about Wal-Mart was not in the file. Duffield said the study already had been made available to the public and therefore did not require a Freedom of Information Act request. Duffield said he'll try to find any permits applications that deal with Wal-Mart and any communication between the Lake Wylie Marine Commission, York County and lawyers, some of which may not have been revealed because of attorney-client privilege.

MacBride said she believed Duffield will give the group the information it requested. Duffield told the group that he would locate e-mails and memos since the last information request.
